DietHelper General Terms of Use and User Licence

1. Purpose

These General Terms of Use and User Licence define the rules applicable to access to and use of:

  • the DietHelper website;
  • the content published on the website;
  • BodyMetrics Free tools;
  • the BodyMetrics Pro service;
  • user accounts;
  • the DietHelper Offline software;
  • DietHelper Basic licences;
  • DietHelper Premium licences;
  • the Coach Power Pack;
  • associated files, materials, documents, interfaces, calculators, modules, and services.

Their purpose is to specify what the user may do, what the user may not do, and the limits of use of DietHelper tools.

These terms supplement the General Terms and Conditions of Sale, the Refund Policy, the Privacy Policy, the Cookie Policy, and the Legal Notice.


2. Publisher of the website and services

DietHelper is a trade name used by Peene Ludovic. In the event of any subsequent official registration of this name, of an associated trademark, or of any change in commercial identity, these terms may be updated.


3. Acceptance of the terms

Access to the DietHelper website, creation of an account, use of BodyMetrics Free, subscription to BodyMetrics Pro, download of a trial version, purchase of DietHelper Offline, or use of a DietHelper licence implies acceptance of these General Terms of Use.

If the user does not accept these terms, they must immediately stop using the DietHelper website, tools, accounts, files, licences, and services.

When a user orders a DietHelper product or service, they also accept the applicable General Terms and Conditions of Sale.


4. Definitions

User: any person accessing the website, using a free tool, creating an account, subscribing to a subscription, downloading a trial version, or using a DietHelper product.

Client: any person who has ordered a DietHelper product or service.

Consumer Client: a natural person using or ordering DietHelper for private use, outside any professional activity.

Professional Client: a natural or legal person using or ordering DietHelper in the course of a professional activity, including coach, personal trainer, nutrition coach, studio, fitness centre, company, self-employed person, or structured team.

DietHelper Offline: nutrition planning software running on Windows PC, based on a compiled Excel/VBA architecture, protected by a licensing system, and delivered as a digital file.

BodyMetrics Free: a set of free online tools offered by DietHelper, with limited or evolving features.

BodyMetrics Pro: paid digital service offered by subscription, giving access to advanced BodyMetrics tools.

Licence: a personal, limited, non-exclusive, non-assignable, and non-transferable right to use a DietHelper product within the limits set out in these terms.

Machine ID: technical identifier generated from the computer used for the activation of DietHelper Offline.

.rkey file: personalised licence file allowing activation of DietHelper Offline on the authorised computer.


5. Access to the website

The DietHelper website is accessible to users with an Internet connection and a compatible browser.

DietHelper endeavours to ensure accessibility of the website, but does not guarantee permanent, continuous, uninterrupted, or error-free access.

Access to the website may be temporarily interrupted for:

  • maintenance;
  • updates;
  • improvement;
  • technical correction;
  • security;
  • hosting incident;
  • outage;
  • force majeure;
  • service provider intervention;
  • modification of services.

The user acknowledges that access to the website also depends on factors external to DietHelper, including their Internet service provider, device, browser, security settings, and the third-party services used.


6. Authorised use of the website

The user is authorised to browse the DietHelper website for personal, informational, professional, or legitimate commercial use, in compliance with these terms.

The user may in particular:

  • view public pages;
  • use the available free tools;
  • create an account where this feature is offered;
  • download a trial version where this option is available;
  • order a product or service;
  • contact DietHelper;
  • view its content, materials, or information;
  • use the tools within the scope authorised by their offer.

Use of the website does not grant any ownership right over DietHelper content, tools, methods, interfaces, software, commercial signs, or technical elements.


7. Account creation

Certain features may require the creation of a user account.

This may concern in particular:

  • BodyMetrics Pro;
  • certain future BodyMetrics Free features;
  • restricted access;
  • subscriptions;
  • protected content;
  • member areas;
  • services linked to Paid Member Subscriptions or any equivalent system.

The user undertakes to provide accurate, complete, and up-to-date information when creating their account.

DietHelper reserves the right to refuse, suspend, or delete an account containing information that is manifestly false, misleading, fraudulent, impersonated, or contrary to these terms.


8. Account security

The user is solely responsible for:

  • the confidentiality of their login credentials;
  • the security of their e-mail address;
  • choosing a sufficiently secure password;
  • any activity carried out from their account;
  • logging out of their account on a shared device;
  • protecting their device against unauthorised access.

Any unauthorised access, suspected hacking, or fraudulent use must be reported promptly to:

DietHelper shall not be held liable for consequences resulting from a weak password, compromised e-mail address, sharing of login credentials, or negligence by the user.


9. Prohibition on account sharing

DietHelper and BodyMetrics accounts are personal.

It is prohibited to:

  • share one’s username;
  • share one’s password;
  • lend one’s account;
  • resell one’s access;
  • make one’s account available to a third party;
  • use one account for multiple unauthorised users;
  • circumvent access limitations;
  • allow a colleague, employee, collaborator, or client to use one’s account in one’s place.

A coach may use BodyMetrics Pro to support an unlimited number of clients, unless otherwise stated in a commercial offer, but may not transfer their account or access to those clients.

In the event of reasonable suspicion of account sharing, DietHelper may suspend or close the account concerned, without refund where a breach is proven.


10. BodyMetrics Free

BodyMetrics Free is a set of free tools offered by DietHelper.

It may include in particular:

  • BMI and health;
  • bone frame size;
  • macro calculator with limited food database;
  • short version of CircaTest;
  • PLC widget;
  • Tempo widget;
  • Tabata Timer;
  • HIIT Timer.

The exact features may evolve over time.

BodyMetrics Free is currently accessible without account creation for certain features. However, DietHelper reserves the right to make all or part of the free access conditional upon the creation of a user account.

Free access to BodyMetrics Free does not create any acquired right to the permanent, free, or unchanged maintenance of the service.

DietHelper may modify, limit, suspend, or remove all or part of BodyMetrics Free at any time.


11. BodyMetrics Pro

BodyMetrics Pro is a paid digital service accessible by subscription.

It gives access to advanced features described on the corresponding commercial pages.

Access to BodyMetrics Pro is subject to:

  • creation or possession of a user account;
  • payment of an active subscription;
  • compliance with these terms;
  • compliance with the General Terms and Conditions of Sale;
  • compliance with account security and usage rules.

BodyMetrics Pro does not include any downloadable software file. It is an online service accessible via the DietHelper website.

DietHelper may develop BodyMetrics Pro features, provided that the essential paid features are maintained during the current subscription period or that a reasonably equivalent alternative is offered.


12. Data entered in BodyMetrics

BodyMetrics tools may allow the user to enter various data, including:

  • last name;
  • first name;
  • e-mail;
  • age;
  • sex;
  • height;
  • weight;
  • measurements;
  • goals;
  • data related to physical condition or health.

No photo is provided for in the BodyMetrics tools.

Unless expressly stated otherwise, data entered in BodyMetrics tools to perform calculations is processed locally in the user’s browser and is not stored on DietHelper servers.

The user is solely responsible for:

  • the data they enter;
  • its accuracy;
  • its relevance;
  • its local deletion;
  • interpretation of the results;
  • use of the results with themselves or with their own clients.

DietHelper shall not be held liable for any incorrect, incomplete, or unexpected result arising from an input error, inaccurate data, incomplete data, or misinterpretation.


13. BodyMetrics exports

Certain BodyMetrics Pro features may allow exports, downloads, or documents, in particular for the full CircaTest or dietary needs assessment.

The user is responsible for:

  • retaining their exports;
  • backing them up;
  • using them;
  • any transmission of them;
  • their compliance with the user’s own professional or GDPR obligations;
  • deleting them when they are no longer necessary.

DietHelper does not guarantee recovery of an export lost, deleted, or not backed up by the user.


14. DietHelper Offline — user licence

DietHelper Offline is made available under a user licence.

The purchase of a DietHelper Offline licence does not transfer any ownership right over the software, its formulas, files, methods, interfaces, licensing system, structured databases, content, or technical elements.

The licence grants only a personal, limited, non-exclusive, non-assignable, and non-transferable right of use, under the conditions set out in these Terms of Use and in the General Terms and Conditions of Sale.

The DietHelper Offline licence allows the authorised client to use the software to create food plans, nutrition documents, and working materials in a compliant personal or professional context.


15. DietHelper Basic

DietHelper Basic is a lifetime DietHelper Offline licence linked to one single user and one single computer.

The Basic licence does not allow:

  • use by multiple users;
  • installation on multiple computers;
  • collective use within a structure;
  • use by an employee, colleague, or collaborator;
  • making the software available to a third party;
  • duplication of the file;
  • transmission of the file or the .rkey file.

A coach may use DietHelper Basic to support their own clients, but may not allow a third party to use their licence.


16. DietHelper Premium

DietHelper Premium is a lifetime DietHelper Offline licence linked to one single user and one single computer.

It may include, depending on the applicable offer, 12 months of BodyMetrics Pro access from the delivery date of DietHelper Premium.

The included BodyMetrics Pro access is not carried over if the user does not use it.

At the end of the included 12 months, the user must voluntarily subscribe to a BodyMetrics Pro subscription if they wish to retain access.

The Premium licence does not allow multi-user or multi-machine use, unless otherwise stated in writing.


17. Coach Power Pack

The Coach Power Pack is reserved for fitness centres, studios, and officially structured teams of personal trainers.

The licences may be installed on a dongle medium and configured in the name of an identified coach.

The coach’s name may appear in the software and on generated or printed documents.

If a coach leaves the structure, it is the responsibility of management to recover the dongle medium and return it to DietHelper to allow a new generation or reassignment according to the applicable conditions.

In the event of return, administrative, technical, and shipping fees may be charged.

In the event of non-return, the request may be treated as a new licence and charged at the applicable rate.

The client structure remains responsible for internal management of media, dongles, access, coaches, and licences.


18. Machine ID and .rkey file

DietHelper Offline uses a licensing system based on a Machine ID and an .rkey file.

The Machine ID is generated from the computer used.

The .rkey file is generated for an authorised user and computer.

The user may not:

  • modify the Machine ID;
  • falsify the Machine ID;
  • attempt to generate a fake identifier;
  • use an .rkey file on another computer;
  • share the .rkey file;
  • circumvent the activation system;
  • attempt to analyse or reproduce the licensing system.

Any attempt to circumvent the licensing system constitutes a serious breach of these terms.


19. Lifetime licence: limits of use

The term “lifetime licence” means that the user has a right to use the relevant DietHelper Offline software without a recurring subscription for that Offline licence, for as long as the technical and contractual conditions are met.

The lifetime licence does not mean:

  • a guarantee of eternal updates;
  • a guarantee of compatibility with all future Windows systems;
  • a guarantee of unlimited recompilation;
  • a guarantee of permanent generation of new .rkey files;
  • a guarantee of free computer changes;
  • a guarantee of eternal maintenance of BodyMetrics Free or Pro;
  • a guarantee that DietHelper’s activity will continue without time limitation.

In the event of the definitive cessation of DietHelper’s activity, DietHelper shall no longer be required to generate new .rkey files, provide new activations, maintain BodyMetrics Free or Pro, or provide future services.


20. Installation and technical environment

DietHelper Offline is designed to run only on a compatible Windows PC, with Windows 10 minimum.

DietHelper Offline is not designed to run on:

  • macOS;
  • iPadOS;
  • iOS;
  • Android;
  • Chromebook;
  • Linux;
  • virtual machines;
  • emulators;
  • Wine, Parallels, or equivalent environments;
  • locked professional systems;
  • restrictive network environments;
  • configurations blocking execution of the software.

DietHelper Offline is signed with a Sectigo certificate. Despite this signature, Windows SmartScreen, Windows Defender, antivirus software, or a firewall may display a warning or block execution.

The user is responsible for verifying the compatibility of their environment before purchase, in particular through the free trial version where available.


21. Backing up DietHelper Offline files

The user is solely responsible for backing up:

  • the .zip file received;
  • the .exe file;
  • the .rkey file;
  • the manual;
  • associated materials;
  • exports;
  • generated data;
  • documents provided to their clients.

DietHelper does not provide automatic external backup for DietHelper Offline.

The user must keep their files on secure media and perform regular backups.

In the event of loss, deletion, corruption, or incorrect handling, a new generation or file resend may be offered only if technically possible and against payment of the fees in force.


22. Change of computer

The DietHelper Offline licence is linked to one single computer.

No free change of computer is included, unless otherwise stated in writing in a commercial offer.

In the event of a change of computer, breakdown, replacement, hardware upgrade, file loss, or request for new activation, the user may request a new generation of the file or .rkey file.

This operation is manual, chargeable, and subject to the rate in force.

DietHelper may refuse a new activation in the event of suspected abuse, fraud, unauthorised use, sharing, technical inconsistency, or breach of these terms.


23. Prohibition on transfer

The DietHelper Offline licence is personal, non-assignable, and non-transferable.

It is prohibited to:

  • sell a licence;
  • assign a licence;
  • transfer a licence;
  • rent out a licence;
  • lend a licence;
  • sell a computer containing DietHelper without prior complete deletion;
  • transfer the .exe file;
  • transfer the .zip file;
  • transfer the .rkey file;
  • allow use by an unauthorised third party.

In the event of sale, assignment, or transfer of a computer containing DietHelper, the user must permanently delete DietHelper, its files, copies, .rkey files, and any element allowing its use.

Any unauthorised transfer may result in suspension of support, refusal of new activation, billing of an additional licence, deactivation of access, and legal proceedings.


24. Intellectual property

The DietHelper website, DietHelper Offline, BodyMetrics Free, BodyMetrics Pro, interfaces, texts, images, videos, methods, calculators, files, materials, templates, structured databases, formulas, modules, licensing systems, and graphic elements are protected by intellectual property law.

Unless otherwise stated, they are the property of Peene Ludovic or are used with authorisation, under licence, or on the basis of accessible sources.

The user acquires no ownership right over these elements.

Any unauthorised reproduction, extraction, adaptation, distribution, resale, rental, modification, or exploitation is prohibited.


25. Commercial signs

The following commercial signs are used by DietHelper:

  • DietHelper;
  • BodyMetrics;
  • BodyFat Blueprint;
  • EnergyScope;
  • CircaTest;
  • MacroScan;
  • MyoFiber;
  • Method 1%.

These signs are not necessarily registered trademarks, unless subsequently stated otherwise.

Any unauthorised use likely to create confusion, free-riding reproduction, unauthorised commercial exploitation, or harm to DietHelper’s image is prohibited.


26. Food databases and sources

DietHelper may use or integrate data from public or accessible food databases, including in particular:

  • CIQUAL;
  • McCance;
  • ASEAN Foods;
  • VEVO;
  • other relevant nutritional sources.

DietHelper does not claim exclusive ownership of public food data as such.

However, the selection, organisation, integration, structuring, interfaces, combinations, tools, methods of use, and DietHelper software experience remain protected.

The user may not extract, reproduce, or substantially reuse DietHelper structured databases for the purpose of recreating a competing product, similar tool, or commercially exploited derivative database.


27. General prohibitions

It is strictly prohibited to:

  • copy DietHelper Offline;
  • copy BodyMetrics;
  • share a DietHelper file;
  • share an .rkey file;
  • share a BodyMetrics account;
  • resell access;
  • rent out access;
  • lend access;
  • make a tool available to an unauthorised third party;
  • extract formulas;
  • extract structured databases;
  • reproduce internal methods;
  • carry out reverse engineering;
  • decompile;
  • circumvent DoneEX, Sectigo, or the licensing system;
  • modify the file;
  • alter the protections;
  • automate access without authorisation;
  • scrape the website;
  • harvest content;
  • mass-copy pages;
  • reproduce the tools;
  • misuse the tools for fraudulent, illegal, or competing purposes.

Any breach may result in immediate suspension of access, refusal of support, refusal of new activation, account closure, absence of refund, and legal proceedings.


28. Absence of public API

DietHelper does not provide a public API, unless otherwise stated in writing.

It is prohibited to automate access to DietHelper tools, pages, calculators, files, or results without prior written authorisation.

The following are prohibited in particular:

  • bots;
  • scraping;
  • automated extraction;
  • collection scripts;
  • circumvention of the user interface;
  • mass requests;
  • test automation;
  • reproduction of calculators;
  • use of data extraction tools.

DietHelper may block, limit, or suspend any access showing automated or abusive behaviour.


29. Comments, forms, and submitted content

If the website allows comments to be left, forms to be sent, requests to be submitted, or content to be communicated to DietHelper, the user undertakes not to transmit:

  • illegal content;
  • insults;
  • threats;
  • harassment;
  • discriminatory statements;
  • defamatory content;
  • misleading content;
  • spam;
  • unsolicited advertising content;
  • malicious files;
  • data belonging to a third party without authorisation;
  • deliberately false information.

DietHelper may delete, ignore, refuse, or report any content contrary to these terms.

The user remains solely responsible for the information they transmit.


30. Professional use

Coaches, personal trainers, studios, fitness centres, companies, self-employed persons, or other professionals may use DietHelper in the course of their activity, subject to compliance with the applicable licence.

The professional remains solely responsible for:

  • the data they collect from their clients;
  • the legal basis for their processing;
  • their GDPR obligations;
  • their advice;
  • their adaptations;
  • their decisions;
  • their results;
  • the relationship with their own clients;
  • compliance of their professional practices.

DietHelper provides decision-support tools, but does not replace the user’s professional judgement.


31. Minors

DietHelper and BodyMetrics tools are not intended to directly collect data from minors without supervision.

Minors may use certain tools only under the supervision of a responsible adult, legal representative, or competent professional.

When a professional uses DietHelper or BodyMetrics with a minor, it is their responsibility to ensure that they have the necessary authorisation, legal basis, or supervision.

DietHelper may delete an account or data where it appears that a minor is using the services without appropriate supervision.


32. Medical, nutritional, and sports-related limitation

DietHelper, BodyMetrics Free, BodyMetrics Pro, and DietHelper Offline are tools designed to assist with nutrition planning, body analysis, estimation, and decision-making.

They do not constitute in any way:

  • a medical device;
  • a diagnostic tool;
  • medical treatment;
  • a medical prescription;
  • pathological care;
  • a substitute for a healthcare professional;
  • a guarantee of weight loss;
  • a guarantee of sports performance;
  • a guarantee of aesthetic, physical, clinical, or metabolic results.

The results provided are indicative and depend directly on the data entered by the user.

Any person with a pathology, medical treatment, pregnancy, eating disorder, specific clinical situation, or medical doubt must consult a qualified healthcare professional before making any nutrition or sports-related decision.


33. User responsibility

The user is solely responsible for:

  • their use of the website;
  • their use of the tools;
  • the data they enter;
  • the accuracy of the information provided;
  • interpretation of the results;
  • decisions made based on the results;
  • use of the documents generated;
  • backing up their files;
  • protecting their account;
  • compliance with these terms;
  • compliance with the laws applicable to their activity.

DietHelper shall not be held liable for consequences resulting from unsuitable use, misinterpretation, an input error, absence of verification, or non-compliance with these terms.


34. DietHelper liability

DietHelper endeavours to provide reliable, structured, and useful tools.

However, DietHelper does not guarantee:

  • total absence of error;
  • total absence of interruption;
  • total absence of incompatibility;
  • perfect suitability for each individual situation;
  • achievement of a nutritional, sports-related, or commercial result;
  • compatibility with all future systems;
  • eternal maintenance of free or paid services;
  • absence of blocking by third-party software.

In the event of a proven technical issue attributable to DietHelper, the user is invited to contact support so that an analysis can be carried out.

DietHelper will use its best efforts to correct, work around, or explain the issue within a reasonable period.


35. Legal guarantee

Consumer users may benefit from legal guarantees applicable to digital content or services under the conditions provided by law.

These guarantees do not cover issues resulting from:

  • an incompatible environment;
  • incorrect use;
  • unauthorised modification;
  • an input error;
  • incorrect handling;
  • unauthorised sharing;
  • absence of backup;
  • use contrary to these terms;
  • expectations not provided for in the commercial offer.

These Terms of Use do not limit the mandatory rights enjoyed by a consumer where such rights cannot be contractually excluded.


36. Suspension, restriction, or removal of access

DietHelper may suspend, limit, or remove access, an account, a licence, or a service where there is a legitimate reason, including in particular:

  • fraud;
  • attempted fraud;
  • account sharing;
  • licence sharing;
  • abusive chargeback;
  • unpaid amount;
  • aggressive behaviour;
  • threat;
  • insult;
  • illegal use;
  • use contrary to these terms;
  • attempted technical circumvention;
  • unauthorised extraction;
  • infringement of DietHelper’s rights;
  • risk to website security;
  • manifest abuse.

In the event of a serious breach, suspension may be immediate and without refund.

DietHelper may also refuse any new activation, in particular in the event of fraud or non-compliant use.


37. Support

DietHelper support is provided by e-mail at:

The indicative response time is 72 business hours.

Support is provided only on business days.

Support mainly covers:

  • installation;
  • activation;
  • difficulties related to the .rkey file;
  • BodyMetrics Pro access;
  • account-related questions;
  • technical errors directly attributable to DietHelper in a supported environment.

DietHelper does not guarantee telephone, urgent, evening, weekend, or public holiday support.


38. Support exclusions

DietHelper may refuse or limit support where the issue results in particular from:

  • an unsupported environment;
  • pirated, modified, or unstable Windows;
  • a locked professional computer;
  • blocking antivirus software;
  • blocking firewall;
  • restrictive corporate network;
  • virtual machine;
  • emulator;
  • modified file;
  • accidental deletion;
  • file loss;
  • local corruption;
  • absence of backup;
  • incorrect handling;
  • unauthorised use;
  • breach of these terms.

In such cases, assistance or file resend may be offered only if technically possible and against payment of the fees in force.


39. Maintenance and evolution

DietHelper may modify, update, improve, suspend, or remove certain features.

This may concern:

  • the website;
  • BodyMetrics Free;
  • BodyMetrics Pro;
  • interfaces;
  • calculators;
  • modules;
  • content;
  • access;
  • free tools;
  • paid tools;
  • the technical structure.

For paid services, DietHelper endeavours to maintain the essential features during the paid period or to offer a reasonably equivalent alternative.

Free features may be modified or removed without notice or compensation.


40. Availability of online services

DietHelper provides online services under a reasonable best-efforts obligation.

DietHelper does not provide any SLA, unless specifically agreed in writing.

Temporary interruptions may occur for maintenance, updates, security, outage, technical incident, service provider intervention, or force majeure.

Reasonable temporary interruptions do not give rise to refund, automatic extension, or compensation.

In the event of a serious and persistent defect affecting a paid service, DietHelper will use its best efforts to restore the service, correct the issue, or propose an appropriate solution.


41. Personal data

Personal data processing is detailed in the DietHelper Privacy Policy.

The user is invited to consult this policy to know:

  • the data collected;
  • the purposes;
  • the legal bases;
  • the service providers;
  • the retention periods;
  • users’ rights;
  • contact procedures.

In the event of contradiction between these Terms of Use and the Privacy Policy on a matter relating to personal data, the Privacy Policy prevails.


42. Cookies

The DietHelper website may use necessary, statistical, advertising, or third-party service cookies.

Information relating to cookies is specified in the Cookie Policy or in the consent management banner.

The user may manage their preferences via the cookie banner or their browser settings.


43. External links and third-party services

The DietHelper website may contain links to third-party websites or integrate external services, including payment services, videos, statistics tools, advertising platforms, forms, or embedded content.

DietHelper does not exercise permanent control over these third-party services.

DietHelper cannot be held liable for:

  • their content;
  • their availability;
  • their security;
  • their cookies;
  • their privacy policies;
  • their terms of use;
  • their commercial practices;
  • their modifications or interruptions.

The user is invited to consult the terms and policies specific to the relevant services.


44. Modification of these Terms of Use

DietHelper may modify these General Terms of Use at any time.

The modifications may in particular be related to:

  • evolution of the services;
  • a technical modification;
  • addition or removal of features;
  • a legal development;
  • modification of the tools;
  • evolution of DietHelper’s organisation;
  • commercial or contractual adaptation.

The applicable version is the one published on the website at the time of use.

For ongoing services, modifications may apply to future services, renewals, online access, support, new activations, computer changes, and updates after they enter into force.

Continued use of the services after publication of the new terms constitutes acceptance, subject to applicable mandatory rights.


45. Partial invalidity

If any clause of these Terms of Use is declared null, invalid, or unenforceable, the other clauses remain applicable.

The clause concerned shall be replaced, as far as possible, by a valid clause pursuing a similar economic and legal objective.


46. Force majeure

DietHelper shall not be held liable for any delay, interruption, or impossibility of performance resulting from an event reasonably beyond its control.

This includes in particular:

  • major server outage;
  • cyberattack;
  • hosting outage;
  • service provider interruption;
  • natural disaster;
  • fire;
  • flood;
  • conflict;
  • administrative decision;
  • pandemic;
  • general Internet outage;
  • blocking by a payment service provider;
  • event seriously affecting DietHelper’s activity.

47. Evidence

The user accepts that the following elements may serve as evidence:

  • exchanged e-mails;
  • order confirmations;
  • invoices;
  • payment histories;
  • technical logs;
  • Machine ID;
  • activation history;
  • subscription history;
  • Stripe, PayPal, Bancontact, or equivalent provider data;
  • download traces;
  • screenshots and technical elements related to support.

The user is responsible for providing a valid, accessible, and regularly checked e-mail address.


48. Amicable settlement

In the event of difficulty, the user is invited to contact DietHelper at:

The parties shall endeavour to seek an amicable solution before any legal proceedings, except in cases of urgency, fraud, unpaid amount, infringement of intellectual property rights, licence breach, or need for protective measures.


49. Applicable law

These Terms of Use are governed by Belgian law.

For consumer users residing in another country, this clause does not deprive the user of the protection of the mandatory provisions applicable in their country of residence where such provisions cannot be contractually excluded.


50. Competent jurisdiction

In the event of a dispute not resolved amicably, the courts of Namur, Belgium, shall have jurisdiction, subject to the mandatory provisions applicable to consumers.

For professional users, exclusive jurisdiction is granted to the courts of Namur, Belgium.
