1. Purpose of this policy

This Privacy Policy explains how DietHelper collects, uses, retains, and protects the personal data of users, clients, prospects, and website visitors.

It applies in particular to:

the diethelper.coach website;
contact forms;
download of the DietHelper Offline trial version;
DietHelper Offline orders;
licence activations;
BodyMetrics Pro accounts;
future BodyMetrics Free accounts;
BodyMetrics Pro subscriptions;
payments;
support requests;
newsletters;
BodyMetrics Free and Pro tools;
cookies, analytics, and advertising trackers.

DietHelper is responsible for the processing of personal data collected in connection with its website, sales, licences, subscriptions, user accounts, support, and communications.

3. Applicable legal framework

DietHelper applies the General Data Protection Regulation, known as the GDPR, as the main basis for the protection of personal data.

As DietHelper is established in Belgium, the processing operations are also subject to applicable Belgian data protection law.

Certain users located outside the European Union may benefit from specific rights provided by the legislation of their country of residence. Where such rights are applicable, DietHelper will examine requests on a case-by-case basis, within the limits of its legal and technical obligations.

4. Data collected

DietHelper may collect different categories of data depending on the use of the website or services.

4.1 Identification data

DietHelper may collect:

last name;
first name;
e-mail address;
postal address;
country;
language;
telephone number if provided voluntarily;
company or professional structure name;
company number or VAT number;
billing information.

4.2 Account data

For BodyMetrics Pro, and in the future for certain BodyMetrics Free features, DietHelper may collect:

account identifier;
e-mail address;
encrypted password or password managed by the WordPress/PMS system;
subscription status;
access level;
login history;
subscription history;
account preferences;
language or country associated with the account.

4.3 Order data

When an order is placed, DietHelper may collect:

product purchased;
selected plan;
order date;
amount paid;
currency;
payment method;
payment status;
invoice number;
client history;
any refunds;
any support requests related to the order.

4.4 Payment data

Payments may be processed by third-party providers, including Stripe, PayPal, Bancontact, or other payment providers used by DietHelper.

DietHelper does not store complete bank card data.

Depending on the provider used, DietHelper may receive or retain:

payment confirmation;
transaction identifier;
amount paid;
currency;
payment status;
payer’s name and e-mail address;
last four digits of the card where transmitted by the provider;
information necessary for invoicing;
subscription or payment history.

Complete banking data is processed by the relevant payment providers according to their own privacy policies.

4.5 DietHelper Offline licence data

For the activation, management, and protection of DietHelper Offline licences, DietHelper may collect:

first name and last name to be integrated into the software;
client e-mail address;
Machine ID;
file or information related to activation;
history of .rkey file generation;
machine change history;
support history;
information related to fraud prevention;
proof of delivery or file sending.

The Machine ID is used to activate DietHelper Offline on the authorised computer, limit unauthorised use, manage computer changes, and protect licences against sharing or duplication.

4.6 Technical data

When using the website, DietHelper may collect certain technical data:

IP address;
browser type;
operating system;
device type;
pages viewed;
date and time of visit;
technical logs;
technical errors;
security data;
cookies;
session identifiers;
browsing data.

This data may be collected through WordPress, hosting, plugins, statistics tools, security tools, or technical providers used.

4.7 Form data

DietHelper may collect data transmitted via:

contact form;
trial version download form;
account creation form;
BodyMetrics Pro form;
future BodyMetrics Free form;
Paid Member Subscriptions checkout;
newsletter form;
support form;
refund request form;
form or questionnaire linked to a DietHelper offer.

The data collected depends on the form used and the fields completed by the user.

4.8 Support data

When a user contacts DietHelper, DietHelper may retain:

product concerned;
exchange history;
screenshots;
technical information provided;
Machine ID if necessary;
proof of payment;
description of the issue;
decisions made in the context of support.

This data is necessary to respond to the request, resolve an issue, document an activation, or retain evidence in the event of a dispute.

5. BodyMetrics Free and BodyMetrics Pro data

5.1 Data entered in BodyMetrics tools

BodyMetrics Free and BodyMetrics Pro tools may allow the user to enter various data, including:

last name;
first name;
e-mail;
age;
sex;
height;
weight;
measurements;
goals;
data related to physical condition;
data that may concern health;
information necessary for nutritional or body-related calculations.

No photo is provided for in the BodyMetrics tools.

5.2 Local processing in the browser

Unless expressly stated otherwise, data entered in BodyMetrics tools to perform calculations is processed locally in the user’s browser.

This means that DietHelper does not store this data on its servers when it is only used in the calculators or widgets provided for that purpose.

The user remains responsible for:

the data they enter;
its accuracy;
its relevance;
its local deletion if it remains present in their browser;
compliance with their own obligations when using the tools with their clients.

5.3 Sensitive data

Certain data entered in BodyMetrics may be considered sensitive or health-related.

DietHelper does not store it on its servers when it is only used in tools operating locally in the browser.

DietHelper does not ask the user to transmit this sensitive data to DietHelper. When the user enters this data in a tool operating locally in their browser, DietHelper does not access it, unless it is voluntarily transmitted by the user in the context of a support request, form, e-mail, or direct exchange with DietHelper.

If the user voluntarily communicates this type of data to DietHelper by e-mail, form, support request, or screenshot, DietHelper will process it only to respond to the relevant request and with particular care.

5.4 BodyMetrics account and subscription data

Data related to the BodyMetrics Pro account, payment, subscription, invoicing, and user access is processed by DietHelper or its providers.

This data is distinct from body or nutritional data entered locally in the tools.

6. Purposes of processing

DietHelper processes personal data for the following purposes.

6.1 Website management

display the website;
secure the website;
manage forms;
ensure WordPress functionality;
prevent abuse;
improve the user experience;
measure audience when consent is required and given.

6.2 Order management

process purchases;
confirm payments;
generate invoices;
manage subscriptions;
deliver digital files;
manage BodyMetrics Pro access;
manage any refunds;
retain contractual evidence.

6.3 Licence activation and protection

generate personalised files;
generate or send the .rkey file;
associate a licence with a user and a computer;
prevent unauthorised duplication;
prevent abusive sharing;
manage machine changes;
retain activation history;
combat fraud.

6.4 Customer support

respond to requests;
resolve technical issues;
assist the user during installation or activation;
verify licence rights;
analyse errors;
document decisions;
retain useful history in the event of a future request.

6.5 BodyMetrics Free and Pro

provide the tools;
manage Pro access;
display results;
allow certain exports available in BodyMetrics Pro;
manage user accounts;
improve features;
prevent abuse or account sharing.

6.6 Communication related to the free trial

When a user downloads the free trial version, DietHelper may send them e-mails directly related to this trial version.

These e-mails may relate in particular to:

proper receipt of the file;
use of the trial;
activation;
expiry of the trial;
generation of the Machine ID;
information necessary for purchase;
a commercial offer directly related to the downloaded trial;
useful reminders before the end of the trial.

These communications are linked to the relationship initiated by the user when downloading the trial.

6.7 Newsletter and marketing

DietHelper may send newsletters, advice, commercial content, or marketing information only where the user subscribes, consents, or where the law allows communication in the context of an existing relationship.

After the sequence related to the free trial, DietHelper may offer the user free content, for example a PDF such as “How to Structure a Food Plan”, in exchange for voluntary subscription to the newsletter.

Subscription to the newsletter is based on the user’s consent.

Each marketing or newsletter e-mail must allow the user to unsubscribe.

6.8 Statistics, analytics, and advertising

DietHelper may use statistics or advertising tools, including:

Google Analytics;
LiteSpeed Analytics;
Rank Math Analytics;
Meta Pixel / Facebook Pixel;
or other equivalent tools used later.

These tools may be used to measure audience, analyse visitor behaviour, improve the website, track conversions, or deliver personalised advertising.

Where required by law, these tools are activated only after the user’s consent via the cookie banner or an equivalent mechanism.

7. Legal bases for processing

DietHelper processes personal data on the following legal bases.

7.1 Performance of a contract or pre-contractual measures

This basis applies in particular to:

process an order;
provide a trial version;
deliver DietHelper Offline;
create a BodyMetrics Pro account;
manage a subscription;
generate a licence;
send the .rkey file;
provide support;
manage a request related to a purchase.

7.2 Legal obligation

This basis applies in particular to:

issue invoices;
retain accounting documents;
comply with tax obligations;
comply with applicable legal obligations;
respond to a competent authority where legally required.

7.3 Legitimate interest

This basis may apply in particular to:

secure the website;
prevent fraud;
protect licences;
retain support history;
defend DietHelper’s rights;
prove an order or activation;
improve services;
manage follow-ups related to a downloaded trial version;
avoid abuse of the trial version;
detect unauthorised use.

DietHelper ensures that this legitimate interest does not disproportionately infringe the rights and freedoms of the persons concerned.

7.4 Consent

Consent may be used in particular for:

newsletter;
marketing communications not linked to an existing relationship;
non-essential cookies;
analytics subject to consent;
advertising pixels;
optional forms;
certain future processing not necessary for the contract.

The user may withdraw their consent at any time, without affecting the lawfulness of processing carried out before withdrawal.

8. E-mails, follow-ups, and newsletter

DietHelper uses several communication systems depending on the mailing level and the type of message, including:

Paid Member Subscriptions;
Fluent Forms;
native WordPress;
Mailchimp;
or any other equivalent tool used later.

8.1 Service-related e-mails

Certain e-mails are necessary or useful for providing the service:

download confirmation;
information about the trial version;
activation assistance;
trial expiry;
Machine ID request;
order confirmation;
subscription confirmation;
technical support;
invoice;
important information about a licence or access.

These e-mails are not necessarily marketing newsletters. They are linked to the contractual or pre-contractual relationship, or to the requested service.

8.2 Follow-ups related to the trial

After download of the trial version, DietHelper may send a sequence of e-mails related to the trial, its use, its expiry, and the possible purchase of DietHelper.

These follow-ups are directly linked to the user’s initial action, namely downloading the free trial.

8.3 Newsletter

Subscription to the newsletter is voluntary.

DietHelper may offer free content in exchange for newsletter subscription, for example an educational PDF.

The user must be able to unsubscribe from newsletter or marketing communications via the unsubscribe link provided in the e-mails, or by contacting DietHelper at:

9. Cookies and trackers

The DietHelper website may use different types of cookies and trackers.

9.1 Necessary cookies

These cookies are necessary for the functioning of the website and may allow:

WordPress functionality;

These cookies do not always require consent when they are strictly necessary for the service requested.

DietHelper may use various technical, commercial, analytical, hosting, payment, or communication providers.

These providers may process certain personal data only to the extent necessary for their assignment.

Hostinger, for hosting;
WordPress, for website management;
Paid Member Subscriptions, for accounts, subscriptions, and payments;
Fluent Forms, for certain forms;
Mailchimp, for certain e-mail communications or newsletters;
Stripe, for payments;
PayPal, for payments;
Bancontact via Stripe, for certain payments;
Google Analytics, for statistics;
Google Tag Manager, if used;
Google Fonts or local fonts, depending on the website configuration;
Google Workspace or Gmail, for certain support exchanges or communications;
Meta / Facebook Pixel, for advertising measurement;
Rank Math, for certain SEO or analytics tools;

Not all of these providers are necessarily active permanently or on all pages.

DietHelper seeks to use providers offering appropriate safeguards with regard to data protection.

11. Transfers outside the European Union

Certain providers used by DietHelper may be located outside the European Union or process data from third countries.

This may include certain payment, e-mailing, analytics, advertising, storage, or technical support services.

Where data is transferred outside the European Union, DietHelper ensures, where required, that appropriate safeguards are provided, such as:

standard contractual clauses;
adequacy decisions;
recognised certification mechanisms;

12. Retention periods

DietHelper retains data only for as long as necessary for the purposes for which it was collected, subject to legal, tax, contractual, or evidentiary obligations.

The main retention periods are as follows.

12.1 BodyMetrics account data

Account data is retained for the lifetime of the account.

After cancellation or inactivity, certain data may be retained for up to 3 years after the last activity or the end of the subscription, in order to allow reactivation, support, contractual proof, and customer relationship management.

12.2 Order, payment, and invoicing data

Data related to orders, invoices, payments, and accounting documents is retained for 10 years, in accordance with applicable accounting and tax obligations.

12.3 Licence data and Machine ID

The Machine ID, activation history, licence information, proof of delivery, and elements related to the .rkey file may be retained for 10 years.

This retention allows:

licence management;
fraud prevention;
support;
computer changes;
contractual proof;
defence of DietHelper’s rights.

12.4 Support data

Support exchanges may be retained for up to 3 years after the last interaction, or longer if necessary in the event of a dispute, fraud, licence request, legal obligation, or contractual proof.

12.5 Newsletter data

Data related to the newsletter is retained until unsubscription or withdrawal of consent.

After unsubscription, DietHelper may retain a minimal record in order to prove withdrawal or avoid involuntary re-registration.

12.6 Form data

Data sent via forms may be retained for the period necessary to process the request, then archived for a reasonable period depending on the nature of the request.

12.7 Cookies

The retention period for cookies depends on the type of cookie, its purpose, and the provider concerned.

Details may be specified in the Cookie Policy or in the consent management banner.

12.8 Data entered locally in BodyMetrics

Data entered locally in BodyMetrics tools is not retained on DietHelper servers when it remains in the user’s browser.

The user is responsible for deleting it locally via their browser, device, or the features provided.

13. Data security

DietHelper implements reasonable measures to protect personal data against:

unauthorised access;
loss;
modification;
deletion;
disclosure;
misuse;
fraud;
technical compromise.

These measures may include:

secure hosting;
limited administrative access;
passwords;
WordPress security systems;
encryption or securing of payments by specialised providers;
limitation of access to data;
separate retention of certain elements;
monitoring of support requests;
vigilance regarding licence files.

However, no method of electronic transmission or storage is entirely risk-free.

The user must also protect their own access credentials, devices, files, passwords, browsers, and backups.

14. User responsibility

The user is responsible for:

the accuracy of the data provided;
the security of their e-mail address;
the confidentiality of their login credentials;
backing up their DietHelper files;
deleting local data in their browser;
using BodyMetrics tools with their own clients;
complying with their own GDPR obligations when acting as a professional.

When a coach, studio, fitness centre, or professional uses DietHelper or BodyMetrics with their own clients, they remain responsible for the data they collect, enter, interpret, or use in the course of their activity.

DietHelper is not responsible for input errors, incorrect use of results, or a professional’s failure to comply with their own obligations towards their clients.

15. Minors’ data

DietHelper services are not intended to directly collect data from minors without supervision.

Minors may use certain tools only under the supervision of a responsible adult, legal representative, or competent professional.

When a professional uses DietHelper or BodyMetrics with a minor, it is their responsibility to ensure that they have the necessary legal basis, authorisation, or supervision.

If DietHelper learns that an account or direct collection concerns a minor without appropriate supervision, DietHelper may delete the relevant data or request additional information.

16. Rights of data subjects

In accordance with the GDPR, data subjects have in particular the following rights:

right of access;
right to rectification;
right to erasure;
right to restriction of processing;
right to object;
right to portability;
right to withdraw consent;
right to lodge a complaint with a data protection authority.

These rights are not absolute and may be limited by legal, tax, contractual, evidentiary obligations, or by DietHelper’s legitimate rights.

For example, certain invoicing data cannot be deleted immediately where it must be retained to comply with accounting and tax obligations.

the identity of the person concerned;
the right exercised;
the data or processing concerned;
any useful information allowing the account, order, or subscription to be found.

DietHelper may request proof of identity where necessary to avoid unauthorised disclosure of data.

DietHelper will respond within a maximum period of one month from receipt of a complete request, unless an extension is authorised by the GDPR in the event of complexity or a high number of requests.

18. Account deletion

The user may request deletion of their BodyMetrics account or DietHelper user account.

Account deletion may result in:

loss of access to BodyMetrics Pro;
loss of certain preferences;
deletion of data associated with the account;
impossibility of reactivating certain access without new registration;
retention of certain data necessary for invoicing, contract, licence, proof, or legal obligations.

Data necessary for invoicing, accounting, defence of rights, or licence management may be retained despite account deletion.

19. Complaint to the supervisory authority

In the event of disagreement regarding the processing of their personal data, the user may contact DietHelper in order to seek an amicable solution.

The user may also lodge a complaint with the Data Protection Authority in Belgium, or with the competent authority of their country of residence where applicable.

20. Third-party links and services

The DietHelper website may contain links to third-party services or integrate content from external platforms.

Vimeo videos;
social buttons;
payment tools;
external forms;

These services may collect their own data, use their own cookies, and apply their own privacy policies.

DietHelper is not responsible for the privacy practices of third-party services.

The user is invited to consult the privacy policies of the relevant services.

21. Modification of this policy

DietHelper may modify this Privacy Policy at any time in order to take into account:

an evolution of the services;
a change of provider;
a technical modification;
a legal development;
a new feature;
a modification of DietHelper’s organisation.

The applicable version is the one published on the website at the time of consultation.
