2. Personal Data Protection and Privacy Policy

DietHelper places the highest importance on confidentiality and the protection of its users’ personal data. This policy informs users about the nature of the data collected, how it is processed, and their rights.

2.1 Data Collected

When using the website or associated services, the following data may be collected:

  • Identification data: name, surname, email, postal address, telephone number
  • Order data: products purchased, license type, customer history
  • Technical data: IP address, browser type, logs, machine ID for activation
  • Cookies and trackers: preferences, browsing statistics, tracking technologies

No banking data is stored directly on the DietHelper.coach website.

Payments are securely processed via trusted third-party providers integrated with WooCommerce, including:

  • Stripe (Visa, Mastercard, American Express, Apple Pay, Google Pay)
  • PayPal
  • Bancontact (via Stripe)

Payment data entered when placing an order is encrypted and transmitted directly to these providers without passing through DietHelper servers. No payment card or account information is visible to or recorded by the site publisher.

When using the free trial license, the machine ID is also stored to prevent fraudulent multiple trials.

2.2 Legal Basis for Processing

Processing relies on the following legal grounds:

  • Contractual performance: order management, delivery, activation
  • Legal obligations: invoicing, tax retention
  • Legitimate interest: fraud prevention, service improvement
  • Explicit consent: newsletters, cookies, forms

2.3 Use of Data

Data is used to:

  • Provide services: software access, activation, after-sales support
  • Manage orders and customer relations
  • Secure access (including trial-related files)
  • Comply with legal obligations
  • Send offers and updates if consent has been given

No data is sold, rented, or transferred to third parties.

2.4 Limited Data Sharing

Your data may only be shared with:

  • Technical service providers: hosting provider, payment platform, email system
  • Competent authorities: in the case of judicial requisition or legal obligation
  • Potential acquirer: in the context of a business transfer, subject to GDPR compliance

Each provider is contractually bound to comply with GDPR.

2.5 Security and Retention

Technical and organizational measures are implemented to protect your data (file protection, pseudonymization of IDs, secured admin access).

Retention periods:

  • Orders and customers: duration of relationship + 3 years for follow-up or archiving
  • Accounting/invoicing data: 10 years (legal obligation)
  • Cookies: maximum 13 months
  • Trial machine ID: maximum 12 months

4. Sources and Credits

Nutritional data used in the DietHelper software partly comes from the CIQUAL 2020 database, published by ANSES (French Agency for Food, Environmental and Occupational Health & Safety).

This database is used in compliance with ANSES conditions, for nutritional planning and dietary coaching purposes.
ANSES does not endorse or approve software or services using this data and cannot be held responsible for its use in the DietHelper software.


5. Images and Icons

Some images and icons on this site come from royalty-free image banks such as:

  • Flaticon
  • Pexels
  • Unsplash

Visuals are used in accordance with the respective license terms.
Rights belong to their authors or respective platforms.

If any error or unintentional license breach occurs, please contact us so we can promptly remove or replace the concerned visual.


6. License Policy – Activation and Device Change

The purchase of DietHelper software includes a lifetime personal license linked to a unique machine ID (generated upon installation on the user’s computer).

Initial Activation:
The license is activated once via a personalized file (.rkey), generated for the device used at the time of purchase.

Device Change:
In case of computer replacement, damage, or hardware upgrade, the user may request a new activation.

  • Up to 2 device changes are included free of charge for the lifetime of the license.
  • From the 3rd change onward, each new activation key is subject to a processing fee of €40.00 incl. VAT (rate 2025).

Processing and Conditions:
Requests are manually processed within 24–72 business hours.
Payment is made via a secure link sent by email at the time of request.

These fees cover:

  • Request verification
  • Secure manual generation of the .rkey file
  • Technical follow-up regarding compliance with usage conditions

The user must keep the original installation file. Additional fees may apply if re-sending or recovery is requested after several years.

License transfer to third parties or unauthorized duplication is strictly prohibited.
Any fraudulent use may result in license deactivation without refund.


7. Data Backup and Loss

DietHelper allows users to export essential client personal data (name, surname, email, etc.), excluding body measurements and tracking history, in PDF format for personal archiving.

Users are solely responsible for regular data backups.
No automatic remote backup is provided by DietHelper, and no data is hosted on third-party servers by the publisher.

Consequently, DietHelper disclaims liability for any partial or total data loss, including:

  • Misuse or mishandling,
  • File corruption,
  • Accidental deletion,
  • Failure to manually back up,
  • Malfunction caused by operating system or third-party updates (Windows, Excel, antivirus, etc.).

Regular backup of the “Client Listing” via generated PDF files (print buttons) is strongly recommended.


8. In Case of Loss, Deletion, or Corrupted File

A simple resend of the file may be offered free of charge within 12 months of purchase.

Beyond 12 months, or in the absence of a backup, a manual recompilation of the software may be offered at €139.00 incl. VAT (excluding shipping and material support costs – e.g., USB keys).

This fee covers:

  • Identity and rights verification,
  • Recovery of original elements,
  • Recompilation and securing of the .exe file,
  • Regeneration of the .rkey key.

This service depends on the technical feasibility of retrieving the archived version sold at the time. If recovery is not possible, the user will be informed by email and no charge will apply.


9. Modifications

This policy may be modified at any time.
In the event of a substantial change, users will be informed via the website or by email.


10. Software Use and Intellectual Property

The DietHelper software, its interfaces, related files, and licensing systems are the exclusive property of Peene Ludovic.

Any attempt at:

  • Decompilation,
  • Reverse engineering,
  • Unauthorized resale or sharing,
  • Alteration of the licensing system,

is strictly prohibited and may give rise to civil or criminal proceedings under the Belgian Code of Economic Law.


11. Applicable Law and Disputes

This document is governed by Belgian law.
In case of dispute, the courts of Namur (Belgium) shall have sole jurisdiction.
