Terms of Use (TOU)

1. Acceptance of the Terms

Access to and use of the DietHelper.coach website (hereinafter “the Site”), published and operated by Peene Ludovic, acting under the trade name DietHelper, implies full and unconditional acceptance of these Terms of Use (TOU) by the user (hereinafter “the User”).

If the User does not accept the TOU, they must immediately cease all use of the Site, products, and related services.

These TOU must be read together with the Privacy Policy and the Refund Policy, which form an integral part of the contract between the User and DietHelper.

2. Legal capacity

The services and products offered by DietHelper are reserved for individuals of legal age (18 years or older) with full legal capacity.

By accepting these TOU, the User declares that they meet these conditions.

3. Description of Services

3.1 Products offered

DietHelper provides nutrition planning software compiled from Excel, available in several versions:

  • Free Trial (7 days, limited features – see section 5.3)
  • Basic: 1-year license
  • Premium: lifetime license
  • Ultimate: lifetime license + access to exclusive content
  • Coach Power Pack: lifetime license + physical USB key + printed syllabus (reserved for fitness centers)

Also offered:

  • physical equipment (skinfold caliper, tape measure, book Conseils de Coachs, etc.),
  • training (online or printed) and educational materials.

4. Access to Software and Activation

4.1 Download and activation

Basic, Premium, and Ultimate versions are delivered via download after purchase.
Activation requires sending a machine ID generated when the software is first opened.

Procedure:

  1. The User downloads the .exe file.
  2. They run the software to generate a unique machine ID.
  3. They send the ID to contact@diethelper.coach.
  4. They receive a personalized license key within 72 business hours.
  5. The license activates automatically once the key is placed in the software folder.

This method protects against unauthorized copies.

Personalization at activation:
When first launched, the User enters their first and last name. These details are embedded in all documents generated by the software and are final.

In case of a clear error (e.g., typo), the User may, within 14 days of purchase, request the resend of the initial file (without recompilation).

Beyond this period, or in case of a machine change, service fees apply:

  • €40.00 incl. VAT (simple new activation)
  • €139.00 incl. VAT (full recompilation)

4.2 Coach Power Pack

The Pack includes:

  • one lifetime DietHelper license per coach,
  • one personalized USB key per license,
  • one printed syllabus,
  • access to in-person or online training.

Specific conditions:

  • minimum order of 5 licenses per center,
  • personalized USB key charged €99.00 excl. VAT per unit,
  • syllabus provided once per center, internal use only,
  • travel/logistics costs apply if training is delivered outside Belgium,
  • loss/theft of a USB key → replacement only with an official police report.

4.3 Free trial version

Duration: 7 days.
Limitations:

  • no printing,
  • CircaTest module unavailable,
  • Recipe module visible but not printable,
  • reduced food database.

The trial is strictly personal and non-transferable.
It is forbidden to share the download link, attempt multiple trials, or extract/divert content.

5. Orders and Payment

5.1 Process

The customer orders via the Site. After payment validation:

  • they receive a download link (digital versions), or
  • a package (Coach Power Pack).

The .zip archive contains all necessary elements (software, key, manuals). The User is responsible for making a personal backup. No resend is guaranteed after 12 months.

5.2 Financial conditions

  • Prices are expressed in euros (€), excl. VAT.
  • Secure payment through third-party providers (Stripe, PayPal, etc.).
  • DietHelper stores no banking data.
  • All orders are final upon validation.

6. User obligations

The User agrees to:

  • provide accurate information during ordering and activation,
  • respect intellectual property rights attached to the software and materials,
  • not use the software for illegal, fraudulent, or prohibited purposes,
  • make regular personal backups of their data.

7. Intellectual Property

All elements of the Site and software are protected by intellectual property law (Belgian Economic Law Code and EU directives).

Any reproduction, distribution, resale, extraction, or reverse engineering is strictly prohibited.

Licenses are personal, nominative, and linked to the User’s computer or the acquiring center. No transfer is permitted without prior written agreement.

8. Refund Policy

Refund conditions are detailed in the Refund Policy available on the Site.

9. Liability

9.1 Warranty limitation

DietHelper is a nutrition planning tool, not a medical device.
No medical or performance results are guaranteed.
The User is solely responsible for use of the software and advice provided to their clients.

9.2 Technical liability

DietHelper shall not be held liable for:

  • incompatibility with non-standard systems,
  • data loss due to misuse,
  • illegal or diverted use of the software.

9.3 Recompilation & paid support

In case of loss/corrupted file, recompilation may be offered within 3 years of purchase, subject to technical feasibility: €139.00 incl. VAT.
Migration to a higher version: manual transfer service available at €40.00 incl. VAT.

9.4 Force majeure

DietHelper shall not be held liable for any failure or service interruption caused by force majeure (server outage, cyberattack, natural disaster, etc.).

10. Personal Data

DietHelper complies with the GDPR (EU) and PDPA (Thailand).

11. Amendments to the TOU

DietHelper reserves the right to amend these TOU at any time.
Any substantial change will be communicated via the Site or by email.

Continued use of the Site or software constitutes acceptance of the new TOU.

12. Governing Law and Jurisdiction

These TOU are governed by Belgian law.

Any dispute falls under the exclusive jurisdiction of the courts of Namur (Belgium), subject to mandatory consumer protection provisions applicable in the User’s country of residence.
